Buffalo License Suspension Lawyer
A Buffalo license suspension lawyer helps drivers facing a New York suspension or revocation from points, tickets, a DWI, a refusal, or an unanswered summons. The New York DMV may suspend a license at 11 points within 24 months. Many other suspensions are mandatory and do not depend on points.
Trbovich Law Firm represents drivers facing license suspensions in Buffalo, Erie County, Niagara County, and across Western New York. The firm is led by Thomas Trbovich. The best time to deal with a suspension is before it happens, while the ticket is still open or the DMV hearing has not yet been held. After that, the options narrow.

How Many Points Does It Take to Suspend a License in New York?
The New York DMV may suspend a license when a driver reaches 11 points within 24 months, counted from the date of each violation. The 24-month window took effect February 16, 2026, replacing the old 18-month window. Separately, 6 or more points within 18 months triggers a Driver Responsibility Assessment.
Some single tickets now come close to the threshold on their own:
- Any alcohol- or drug-related conviction or incident: 11 points
- Aggravated unlicensed operation: 11 points
- Speeding more than 40 mph over the limit: 11 points
- Speeding 31 to 40 mph over, speeding in a work zone, or passing a stopped school bus: 8 points
- Speeding 21 to 30 mph over: 6 points
- Cell phone or texting, failure to exercise due care, or reckless driving: 5 points
- Speeding 11 to 20 mph over: 4 points
- Speeding 1 to 10 mph over, red light, or stop sign: 3 points
A school bus ticket plus a 1 to 10 mph speeding ticket reaches 11 points. Two phone tickets plus a 1 to 10 mph speeding ticket in two years reach 13. The full point table is on the Buffalo traffic ticket lawyer page.
What Tickets Cause a Mandatory License Suspension in New York?
Some New York suspensions and revocations are mandatory once a driver is convicted, regardless of points. They include three speeding or misdemeanor traffic convictions within 18 months, two work zone speeding convictions within 18 months, and phone or texting convictions for junior and probationary drivers. A court or the DMV cannot waive them.
- Three speeding or misdemeanor traffic convictions within 18 months: revocation of at least six months under VTL 510
- Two work zone speeding convictions within 18 months: a mandatory suspension
- Junior license, learner permit, or probationary license phone or texting conviction: a 120-day suspension on a first conviction, and at least a one-year revocation for a second within six months of restoration
- Probationary license violations: a suspension for certain moving violations during the probation period after a road test, including speeding and reckless driving
- DWAI-alcohol: a 90-day suspension on a first conviction
- DWI, DWAI-drugs, and chemical test refusal: revocations of at least six months to one year or more
Because these consequences follow the conviction automatically, the way the ticket itself is resolved is usually the only place to change the result. See the Buffalo distracted driving ticket lawyer page for phone and texting tickets.
What Non-Driving Reasons Can Suspend a License in New York?
A New York license can be suspended for reasons that have nothing to do with how a person drives. These include failing to answer a ticket, failing to pay a Driver Responsibility Assessment, an insurance lapse, unpaid child support, unpaid state taxes, failing to file a crash report, and paying the DMV with a dishonored check.
- Failure to answer or appear: the court notifies the DMV when a ticket goes unanswered, and the suspension stays until the ticket is answered
- Driver Responsibility Assessment: the license is suspended until the assessment is paid
- Insurance lapse: a lapse in auto insurance can lead to civil penalties or a suspension tied to the length of the lapse
- Child support: a support collection unit or Family Court can trigger a suspension for arrears
- State taxes: the Department of Taxation and Finance can suspend a license for unpaid tax debt over a set amount
- Crash reports and dishonored checks: suspensions until the report is filed or the payment is made good
Since the Driver's License Suspension Reform Act took effect in June 2021, New York no longer suspends licenses for unpaid traffic fines. Payment plans are available instead. Failing to appear still leads to a suspension.
Can the DMV Suspend Your License After a Crash?
Yes. After a crash that causes a death or serious injury, the New York DMV can schedule a safety hearing even if no one was convicted of a crime. An administrative law judge can suspend or revoke the license if the evidence shows the driver violated the Vehicle and Traffic Law and contributed to the crash.
These hearings are separate from any criminal or civil case. The driver can testify, present witnesses, and cross-examine the officer. What the driver says at a DMV hearing can be used in other proceedings, so preparation matters, especially when criminal charges or a lawsuit are possible.
What Happens at a DMV Suspension Hearing in New York?
A DMV suspension hearing is held before an administrative law judge, who reviews the evidence and decides whether to suspend or revoke the license. Common hearings include chemical test refusal hearings, point and persistent violator hearings, and crash safety hearings. The driver can be represented, present evidence, and question the officer.
Practical points about DMV hearings:
- A chemical test refusal hearing must be held within 15 days of arraignment, or the temporary suspension ends
- If the officer fails to appear at a refusal hearing, the hearing may be adjourned or the charge may be dismissed, depending on the circumstances
- Missing a hearing usually means a suspension or revocation is entered by default
- A driver who loses can appeal to the DMV Administrative Appeals Board, which has strict filing deadlines
- Testimony at a DMV hearing is recorded and can be used later

How Long Is a License Suspension in New York?
The length of a New York license suspension depends on the cause. Some last a fixed period, such as 90 days for a first DWAI-alcohol or 120 days for a junior driver's phone ticket. Others last until a condition is met, such as answering a ticket or paying an assessment. Revocations last at least six months to a year or longer.
- Failure to answer a ticket: until the ticket is answered
- Driver Responsibility Assessment: until paid
- DWAI-alcohol, first offense: 90 days
- Zero Tolerance, under 21: six months for a first finding
- Junior or probationary phone or texting conviction: 120 days
- Three speeding or misdemeanor traffic convictions within 18 months: revocation of at least six months
- DWI, first offense: revocation of at least six months
- Chemical test refusal: revocation of at least one year
- Suspension pending prosecution in a DWI case: until the case ends

Can You Stop a License Suspension Before It Happens?
Often, yes, by acting while the ticket is still open. A ticket can sometimes be reduced to a lower-point or no-point violation, which can keep a driver under 11 points. A Point and Insurance Reduction Program course can cut up to four points for suspension purposes. Answering every ticket on time prevents failure-to-answer suspensions.
Steps that can keep a license from being suspended:
- Check the DMV abstract to see the current point total and which tickets are still within 18 and 24 months
- Answer every ticket before the date on it, even if the plan is to contest it
- Seek a reduction through the Buffalo Traffic Violations Agency or the local prosecutor where available
- Request the officer's supporting deposition in courts where it applies
- Take a PIRP course before the points reach 11, since it does not undo a suspension already imposed
- Pay any Driver Responsibility Assessment or set up installments before the deadline

What Happens if You Drive With a Suspended License in New York?
Driving with a suspended or revoked license in New York is aggravated unlicensed operation under VTL 511, a crime. The third degree is a misdemeanor with a $200 to $500 fine and up to 30 days in jail. Since February 16, 2026, a conviction adds 11 points. Higher degrees apply for alcohol-related suspensions.
The prosecution must prove the driver knew or had reason to know of the suspension. DMV notices mailed to the address on file often supply that proof, which is why keeping the DMV address current matters. Clearing the underlying suspension before the court date can affect how the charge is resolved. Details on clearing suspensions are on the Buffalo license reinstatement lawyer page.
How Does a Suspension Affect Commercial and Out-of-State Drivers?
A suspension or revocation of the base license also suspends commercial driving privileges. Some convictions disqualify a CDL even when the regular license stays valid. Out-of-state drivers lose the privilege to drive in New York, and the home state may act under the Driver License Compact.
Commercial drivers face federal disqualification rules under 49 CFR 383.51, including 60 or 120 days for two or three serious traffic violations within three years. Canadian drivers from Ontario and Quebec may see New York convictions on their home records through reciprocal agreements. See the Buffalo CDL DUI lawyer page.
